Security Reminders

Dear Residents,

During the Holidays, please be extra careful regarding security.  In one of our buildings, we recently had a package thief call a resident from the Lobby Directory claiming to be a delivery person.  Do not buzz anyone in the building if that person is not your guest.  Do not allow anyone to enter the building while you are entering or exiting.  If someone forces his/her way in, notify the Office and/or call OPD, as it appears appropriate, without confronting the person and putting yourself in danger.

While driving into or leaving the garage, wait for the gate to close. Do not “piggyback” or “tailgate” another resident while entering the garage. If someone drives into the garage behind you as you enter, do not put yourself in danger by confronting him/her/them.  Notify the Office and/or call OPD, as appropriate.  Do not leave your garage gate opener in your car.

Notice of 28-day comment period for 3 Proposed Rule Revisions

The Board has approved 1 new Rule & 2 updates to existing Rules. This posting is to open a 28-Day Comment Period effective today, December 28, 2023, during which owners may make suggestions to approve, modify, or disapprove changes to the following.

New General Rule (#21) which states only items allowed to be deposited in the Recycling bins by Cal Waste Solutions, State Law or the Oakland Recycles website are permitted to be deposited into the Recycling bins in the garages.  Only compostable items may be placed in the compost bins.  A maximum of two 30 Gallon garbage bags of construction debris may be placed in our garbage bins.  Owners and/or their Contractors must dispose of any additional debris away from our premises.  A violation of a General Rule may be subject to a $500 fine and because this rule will be posted on the Recycling bins within the view of someone near the bins, a violation may result in a Fine upon the first violation.

General Rule #19 Revision:  Charcoal and other open-flamed grills may not be used on any unit’s patio or balcony or common area patio.

General Rule #11 Revision of existing 35-pound Dog Rule:  Pets:  DOG RULES:  Variance appeals over the weight-limit due to the dog being an Emotional Support Animal must be accompanied by an Emotional Support Animal letter written and signed by a licensed mental health professional. The licensed mental health professional writing the letter must hold a legitimate and active license. In the ESA letter they must include their license number, effective date, jurisdiction and type of license. They must be licensed to provide professional services within the scope of the license in the jurisdiction in which the documentation is provided. The licensed mental health professional must have a relationship with the client at least 30 days before providing the Emotional Support Animal Letter. They must conduct a clinical evaluation of the client to assess the need for an emotional support animal. This Rule Change will not affect owners or their tenants who already have a dog over 35 pounds, whether or not the dog has been designated as an Emotional Support Animal.   The adoption of this Rule Change will be no earlier than January 2024.  i.e. Such dogs will be “grandfathered”.

In the future, should there be a change in California Law AB 468 ESA, this Rule will change accordingly.

Pool Land Annexation Amendment was approved by the Membership.

Pool Land Annexation Amendment: Our volunteer Inspector of Elections, Gary Alpert, reported that there were 116 Yes votes for the annexation and 2 No votes.  The Manager will inform our attorney that the First Amendment to the First Amended and Restated Covenants, Conditions and Restrictions has been approved by the membership.
